Terms of Service

1. Who we are

drakecode.com is run by AlterAim, LLC, doing business as DrakeCode (“DrakeCode”, “we”, “us”), a Nevada limited liability company at 400 South Fourth Street, Suite 540, Las Vegas, Nevada 89101. “You” means the person using the site, and the business you use it for.

2. You must be 18 or older

You must be at least 18 years old to use drakecode.com, book a call, or sign up for our text messages. By using the site you confirm that you are.

3. What we do, and what this site is for

DrakeCode designs and builds websites for businesses. This site shows what we make and lets you book a call with us. Booking a call is free and does not commit you to buy anything.

A website project is governed by its own agreement. If you hire us, the Website Service Agreement and Order Form you sign set the price, payments, timeline, revisions, refunds, ownership and everything else about the project. Nothing on this site is an offer or a quote, and where your signed agreement and these terms differ, your signed agreement wins.

4. Booking a call

• Give your real name and contact details, and book only calls you mean to attend.
• The times shown are the times free on our calendar when you looked. A booking is confirmed when the site tells you so and the confirmation reaches your email.
• If you need to change or cancel, use the link in your confirmation email or contact us. We may need to move or cancel a call too, and if we do, we will tell you and offer a new time.
• We may decline or cancel bookings that look automated, abusive, or made with someone else’s details.

5. Text messages (SMS)

The program. When you book a call, you may opt in to receive text messages from DrakeCode (AlterAim, LLC) by ticking the SMS consent box on the booking form. The box is optional, never ticked for you, and not a condition of booking a call or of buying anything from us.

What we send. Messages about the call you booked: a confirmation when you book it, reminders before it starts, and an update if its time changes or it needs to be moved. We do not run a marketing text program, we do not send messages on behalf of third parties, and we do not text numbers we got from anyone but you.

Message frequency varies. Message and data rates may apply. Reply STOP to opt out at any time, or HELP for help. You can also reach us at contact@alteraim.com or (702) 707-6442. Opting out of texts does not cancel your call.

Carriers. Mobile carriers are not liable for delayed or undelivered messages. Delivery is not guaranteed and depends on your carrier, device and coverage. Any message and data charges are between you and your carrier.

6. Using the site fairly

Please do not:

• break the law, or use the site to harm, mislead or harass anyone;
• try to get into parts of the site or our systems you are not meant to reach, or test them for weaknesses;
• overload the site, or use bots, scrapers or other automated tools on it or its booking form;
• copy, download or re-upload the site’s code, 3D models, images, sounds or fonts.

We may block anyone who does, without notice.

7. Who owns what on this site

The site and everything in it, including its design, code, 3D models, images, animation, sounds, text and the DrakeCode name and logo, belong to AlterAim, LLC or to the people who licensed them to us. You may view the site for your own use. Anything else needs our written permission.

The typefaces belong to their designers and are used under their licences (see Credits below). Their licences do not allow anyone to download them from this site and use them elsewhere.

If you send us ideas or feedback about the site, we may use them freely, without owing you anything.

8. Other companies' services and links

The site relies on other companies to work, such as our hosting provider and the scheduling platform behind the booking form, and it may link to other websites. We are not responsible for their content, availability or practices, and their own terms apply when you use them.

9. What we do not promise

We work to keep the site accurate and available, but it is provided “as is” and “as available”. We do not promise that it will always be online, free of errors, or work on every device. As far as the law allows, we give no other warranties, express or implied, including any implied warranty of merchantability, fitness for a particular purpose or non-infringement.

Examples, previews and results shown on the site are illustrations, not promises of what your website or your business will achieve.

10. The limit on what we can owe you

As far as the law allows, we are not responsible for indirect losses arising from your use of the site or a call booked through it: lost profits, revenue, business, customers or data, or damage to reputation, even if we were told they were possible. For anything else, the most we can owe you in total for the use of the site is one hundred US dollars ($100).

This limit does not apply to our own fraud, or to anything the law does not let us limit. If you are a client, the limits in your Website Service Agreement apply to your project instead.

11. If your use of the site causes a claim

If someone makes a claim against us because you broke these terms or misused the site, you will cover our reasonable costs of dealing with it, including legal fees.

12. If we disagree

We would like to keep this simple and cheap for both of us, so there are three steps, in order:

• Talk to us. Email contact@alteraim.com describing the problem, and give us 30 days to try to fix it. Almost everything ends here.
• Small claims court. If it is not resolved after 30 days, either of us can file in small claims court in Clark County, Nevada.
• Regular court. Anything above the small claims limit goes to the state or federal courts in Clark County, Nevada, and we both agree to those courts.

Nevada law governs these terms, without regard to conflict of laws rules. Either of us may go straight to court for an urgent order to stop misuse of confidential information or intellectual property.

13. Changes to these terms

We may update these terms. The new version is posted here with a new date at the top, and applies from then on. It does not change a call you have already booked or an agreement you have already signed.

14. The fine print

• These terms and our Privacy Policy are the whole agreement about your use of the site.
• If any part of them cannot be enforced, the rest still stands.
• If we do not enforce something once, we can still enforce it later.
• We may transfer these terms if our business is sold or reorganized, including to a new DrakeCode company.
• Neither of us is responsible for delays caused by things genuinely beyond our control.
